The High Court has dismissed claims worth more than $4m brought against Mishcon de Reya. Investors in commercial property transactions alleged that monies paid into the firm’s client account were disbursed in breach of a purported Quistclose trust. They also alleged that the firm was liable in dishonest assistance and for a purported conspiracy to defraud. Had the claimants succeeded, they would also have sought to recover many millions of pounds in alleged consequential losses said to relate to the property transaction. Following an eight day trial, His Honour Judge Hodge QC (sitting as a Judge of the High Court) dismissed each claim in its entirety.
