Mann J's judgment contains the first consideration of the application of the first two grounds for seeking a declaration of ineffectiveness in relation to a concluded contract to which European procurement rules apply and of the specific limitation provisions applicable to such proceedings. The Claimant sought a declaration of ineffectiveness on the ground that the concluded contract differed materially from the requirements of the entity procuring it and from the bid of the company awarded it. Mann J struck the claim out.
