The case concerned the conviction of four journalists for having recorded and broadcast an interview of a private insurance broker using a hidden camera. The recording was part of a television documentary intended to denounce the misleading advice provided by insurance brokers.

The judgment finds that journalists have an Art 10 ECHR right to use undercover reporting techniques so long as done in good faith to reveal a story of real interest and the recorded results are presented with sensitivity to the competing Art 8 rights of those filmed.

The press release outlining the judgment can be read by clicking on the attached document.

Tom de la Mare QC acted for the Media Legal Defence Initiative which intervened in the case.
