In a judgment handed down on 16 January 2015 Mr Justice Henderson held that Pakistan had irrevocably waived state immunity and submitted to the jurisdiction of the High Court. The proceedings concern funds held in an account at the National Westminster Bank Plc and previously frozen for more than 60 years pursuant to the judgment of the House of Lords in Rahimtoola v Nizam of Hyderabad [1958] AC 379. In 2013 Pakistan had first commenced, and then discontinued, proceedings and the Bank, the Union of India and the President of India and other interested parties successfully applied to set aside the Notice of Discontinuance.
