The Competition Appeal Tribunal has allowed the appeals against the OFT’s decision that tobacco retailers and manufacturers had engaged in anti-competitive practices. The appeals were allowed, and the decision quashed, part way through the hearing following the OFT’s application to rely on a “refined case”.
