In this important judgment, the Court of Appeal held that the Independent Police Complaints Commission may not express conclusive findings on whether or not a police officer’s conduct was unlawful and/or reasonable when carrying out an investigation under special requirements as defined the legislation. In such cases, the IPCC is confined to stating whether the officer had a case to answer in misconduct proceedings and/or referring the matter to the prosecuting authorities where appropriate.
