The High Court has rejected an attempt by the Security Services to strike out private claims brought by 12 Libyans against them and others, holding that the false imprisonment and other claims premised on unlawful immigration detention or unlawfully imposed Control Orders (both forms of administrative order amenable to judicial control, but not judicially imposed detention) could be brought without seeking to bring appeals against earlier SIAC or High Court rulings.  The private claims arose from documentation found in Libya after the fall of the Gaddafi regime which the Claimants allege show undisclosed UK complicity in extraordinary rendition and other wrongdoing.

Tom de la Mare QC led the team acting for the 12 Claimants.
