Nick De Marco has successfully obtained an interim “continuation order” from the Leeds Employment tribunal, effectively forcing Wakefield City Council to continue to employ the local National Association of Head Teachers’ branch secretary in an important case for trade union rights. In order to obtain the interim relief the Tribunal had to be persuaded it was ‘likely’ the claimant would succeed in a claim for trade union victimisation.

It is unusual for this type of order to be granted; the case will now be set down for a full trial.
