Tom Croxford acted for Mr Asoyag in setting aside an injunction preventing him from joining GFI until the expiry of his restrictive covenants. The Judge held that the covenants did not prevent work taking place where Phoenix had ceased to undertaken work of a similar type as a result of Mr Asoyag’s departure and also held that any damage sustained by Phoenix was quantifiable and thus an injunction was inappropriate.
