The Supreme Court (Lord Reed, Lord Carnwath, Lord Hughes with Lady Hale and Lord Kerr dissenting), rejected a challenge to the Government’s ‘Benefit Cap’ legislation.

The Appellants, supported by interveners (Child Poverty Action Group and Shelter), argued that the legislation contravened their rights under the European Convention on Human Rights (Article 8 and/or Article 14 read with A1P1 or Article 8). The majority rejected that challenge and held that the ‘Benefit Cap’ was lawful.
