Legal privilege to accountants offering tax advice has been refused by the Supreme Court.

The Supreme Court has upheld the Court of Appeal's decision in this case.  Prudential claimed that it was not obliged to hand documents recording advice from accountants over to HMRC.  The Court of Appeal held that it was obliged to do so.  The Supreme Court held by a majority of 5:2 that legal advice privilege did not extend to cover tax advice by accountants.

James Eadie QC acted for HM Revenue & Customs and Lord Pannick QC acted for Prudential.
