The Court of Appeal has ruled in favour of attendees of a protest camp outside the MOD’s nuclear facility at Aldermaston, upholding their argument that MOD’s recent byelaws banning the camp violated their freedom of expression, assembly and association rights. Overturning the Judgment of the Divisional Court, the Court of Appeal held that the MOD’s objections to the camp did not constitute a pressing social need, sufficient to justify an interference with freedom of expression.
