W v Registrar of Marriages

In a test case concerning the right of transsexuals in Hong Kong to marry, the Hong Kong Court of First instance (Andrew Cheung J) held that it was not possible to interpret the Marriage Ordinance so as to enable transsexuals to marry in their acquired gender.  Nor was the inability of transsexuals to marry members of the same biological sex inconsistent with the Basic Law or ICCPR as applied in Hong Kong through the Hong Kong Bill of Rights.  Monica Carss-Frisk QC, together with Lisa KY Wong SC and Stewart KM Wong, instructed by the Department of Justice, represented the Respondent.
