In a judgment handed down on 13 November, Mr Justice Knowles CBE determined a high-profile contractual dispute between the well-known boxing promoter and manager, Frank Warren, and the former WBO Lightweight and super featherweight champion, Ricky Burns.

The dispute arose out of the breakdown in the parties’ management and promotional relationship in March 2013, when Mr Burns terminated his agreements with Mr Warren.  Knowles J found that unpaid sums of commission were owed to Mr Warren and that Ricky Burns had not been justified in purporting to repudiate his agreement with Mr Warren’s promotional company, W. Promotions Limited (“WPL”).

The Court dismissed a claim, assigned to Mr Warren by WPL, for loss of profits arising from that termination, on the basis of the evidence of loss before it. The case raised interesting questions of waiver, and the circumstances in which late payment amounts to repudiatory breach.
