Yesiloz v London Borough of Camden and Secretary of State for Work and Pensions

May 09

[2009] EWCA Civ 41

The Court of Appeal has given judgment in the case of Yesiloz v London Borough of Camden and Secretary of State for Work and Pensions

The case concerned the question of whether nationals of Turkey, a state party to the European Convention on Social and Medical Assistance, who were asylum-seekers on temporary admission to the UK, had a ‘right to reside’ for the purposes of social security legislation.  The Court of Appeal held, on the basis of its recent decision in R (YA) v Secretary of State for Health (2009), that they had no such right.

Emma Dixon was counsel for the Secretary of State.
