Using the ECHR to Supplement the Refugee Convention

The most obvious way in which the ECHR can provide an alternative route to protection, where the Refugee Convention cannot assist, is through reliance on Article 3 ECHR. Article 3 may, for example, come into play where the Refugee Convention would not, because anticipated ill-treatment will not be persecution for one of the Refugee Convention reasons, such as race, religion, or nationality.
