Jessica was taken on as a tenant at Blackstone Chambers in September 2008 following the successful completion of her 12-month pupillage. Her pupil supervisors were Andrew Hunter, Jane Collier, Javan Herberg, and Tom Croxford.
During pupillage Jessica acquired experience in a range of courts and tribunals, including county courts, employment tribunals, the High Court and the Court of Appeal.
Public Law and Human Rights
Jessica has appeared before the Special Educational Needs and Disabilities Tribunal representing a special needs child against the Local Education Authority. She has also assisted in a number of high level Public Law, EU and Human Rights cases in the High Court, the Court of Appeal and the Asylum and Immigration Tribunal. These included:
MA (Palestine) v Secretary of State for the Home Department [2008] EWCA Civ 304, considering, among other things, whether it would be persecution for a stateless person to be denied entry into his country of permanent residence (assisting pupil supervisor Jane Collier).
J v SSHD [2008] AS/59067/03, AIT, considering the legality of returning a homosexual man to a country where he would have to repress his sexuality (assisting pupil supervisor Jane Collier).
R (on the application of Teesside Power Ltd) v Gas and Electricity Markets Authority [2008] EWHC 1415 (Admin), considering the extent of the GEMA’s authority to vary a timetable for the implementation of potential changes to the electricity industry’s Balancing and Settlements Code (assisting pupil supervisor Javan Herberg).
Employment
Jessica is a member of the Free Representation Unit and has represented clients in relation to unfair dismissal and wrongful dismissal claims. As Tom Croxford’s pupil, she has had experience of a wide range of issues in employment law, including restrictive covenants, whistleblowing, TUPE transfers and discrimination. She assisted Tom in the following cases, among others:
Seldon v Clarkson Wright Jakes (awaiting judgment): the first appeal brought to the EAT under the Age Regulations 2006, concerning whether it is discriminatory for a solicitors’ partnership to operate a compulsory retirement age.
Ministry of Sound v Ben Cook HQ08X00407: a defendant’s application to strike out a claim for damages brought by an employer.
IB4AI LLC v Auriel Capital (Cayman) Ltd [2008] All ER (D) 288: a case concerning the meaning of “total base fees” in a marketing agreement between a marketing agent and a hedge fund.
Commercial
Jessica assisted pupil supervisor Andrew Hunter in the preparation of a wide range of commercial cases and hearings, including mediations and arbitrations. She helped with advisory work on number of issues including the meaning of ‘follow the settlements’ clauses in reinsurance contracts, commercial fraud by government contractors, and the obligations of financial service providers under MiFID.
Regulatory
Jessica assisted her pupil supervisors in advising various public bodies, including Ofcom, Ofgem and the BBC, in relation to their statutory powers and duties. In the case of the BBC, this involved the provision of extensive written advice in relation to its duties under disability legislation.
Media and Entertainment
As Andrew Hunter’s pupil, Jessica was involved in a number of media cases. These included a number of disputes relating to copyright.
Sport
As Andrew Hunter’s pupil, Jessica was involved in a number of sports cases. These included ongoing disputes between McLaren and the FIA in relation to the Brazilian Grand Prix and the conduct of an investigation into McLaren’s 2008 car, and a breach of contract claim by a football agent against a player.
