On 8 February 2019, the Divisional Court handed down judgment in the fifth piece of litigation in the English High Court concerning the depopulation of the British Indian Territory (the Chagos Islands).
In this claim two former islanders challenged both the Government’s decision not to resettle the BIOT and also the Government’s creation of a Support Package to assist former islanders and their descendants in their current locations. The Divisional Court dismissed all of the claimant’s grounds of challenge and has refused permission to appeal to the Court of Appeal.
