The review team is interested in hearing from those who have views about the Maxwellisation process and/or practical experience of its operation in specific inquiries, investigations and reviews.

The House of Commons Treasury Committee has commissioned Andrew Green QC to lead a team from Blackstone Chambers - Tony Peto QC, Pushpinder Saini QC, Fraser Campbell and Ajay Ratan - to conduct a review of “Maxwellisation” and its use in public inquiries, investigations and reviews.

Maxwellisation is the process whereby, prior to any criticism being made of a person in a public report, that person is provided with relevant parts of the draft report or a summary of such proposed criticism, in order to make any representations on the proposed criticism, prior to publication of the final report.

The review team will focus particularly on the application of this process in cases of public reports covering financial matters, and will seek to set out:

(1) What the law requires;

(2) The typical problems that arise during the process, including addressing the public’s concerns around the additional time and financial costs incurred; and

(3) Recommendations or a set of principles to identify ways to ensure the use of this process in relation to public reports covering financial matters is fair and proportionate.

The review team is interested in hearing from those who have views about the Maxwellisation process and/or practical experience of its operation in specific inquiries, investigations and reviews.

There is no prescribed format or list of questions, but the team is particularly interested in evidence regarding: (1) the impact of Maxwellisation, in terms of delay and cost, in specific inquiries, investigations or reviews; (2) the success or failure of Maxwellisation in improving the fairness and accuracy of specific public reports; and (3) steps that can be taken in the course of inquiries, investigations and reviews that might avoid or reduce the need for Maxwellisation.
