This article appeared in Competition Law Journal 2009.It is now 6 years since the Competition Act 1998 (CA 1998) was amended to enable victims of anti-competitive behaviour to 'piggyback' on infringement findings to recover their loss in the Competition Appeal Tribunal (CAT). Section 47A was intended to reduce the legal costs incurred in recovering this loss, and to enable such claims to be heard by the specialist competition tribunal.
