The ECJ on 5 March 2009 produced its judgment in Age Concern/Heyday’s judicial review of the mandatory retirement age of 65 contained in the Employment Equality (Age) Regulations.

The ECJ on 5 March 2009 produced its judgment in Age Concern/Heyday’s judicial review of the mandatory retirement age of 65 contained in the Employment Equality (Age) Regulations.

The Court has held that the provision is capable of being justified, and has referred the case back to the Administrative Court for determination of the question whether it is in fact justified. Dinah Rose QC represents the Secretary of State in these proceedings.
