Where the media were considering publishing an article in relation to a criminal trial where there were outstanding jury verdicts, there was a particular need for caution and a careful and detailed analysis prior to publication. In imposing a penalty for contempt of court on two publishers, their unawareness of that need was an important mitigating factor but that would no longer be seen as an excuse.
