Instructed in the Court of Appeal and the House of Lords on behalf of the Home Secretary in combined cases involving a challenge to a legislative scheme aimed at preventing “sham” marriages, whereby individuals subject to immigration control are in certain circumstances required to obtain the permission of the Home Secretary to marry.  The cases raise issues concerning the right to marry under Article 12 ECHR.
