Bord na Mona v BPI and others

Defence of application for summary judgment in claim for damages in respect of the industrial plastic bags cartel. Kieron Beal QC was instructed on behalf of the Claimants in this action for damages arising out of the operation of the cartel. Flaux J held that given the asymmetry of information between the Claimants and the cartelist Defendants, the claim was sufficiently particularised. Fraser Campbell was instructed as junior counsel for the Claimants.
