In an application to strike out a claim brought against Ali Campbell, Mickey Virtue and Astro, of UB40, the Divisional Court considered whether or not it was arguable that all of the original rights to the name UB40, which had been owned by a trading company during UB40’s heyday, which is now in liquidation, had been abandoned. The Court held that this was arguable and therefore refused the application. The court also considered claims by the Claimants, former Members of the original UB40, that they owned the UB40 domain name. The judge refused to allow this claim to go forward.
