Tom Weisselberg appeared on behalf of Carlton in this unusual application for a Norwich Pharmacal Order. Carlton' s application was made on notice to VDC and was opposed by VDC. Carlton knew the identity of the proposed Defendant (VCI) but wished to obtain documents without which it could not start proceedings (in that it had a suspicion of wrong-doing on the part of VCI but lacked sufficient information to sign a statement of truth to commence proceedings). Jacob J held that the Court had jurisdiction to make the Order sought by Carlton and exercised his discretion in Carlton's favour by ordering VDC to disclose the requested documents.
