Coke-Wallis v Institute of Chartered Accountants of England and Wales

Acting for ICAEW in a judicial review claim brought by a member seeking to challenge the ICAEW’s decision to prefer a second disciplinary complaint against him following the dismissal of the first complaint, in circumstances where both complaints were based on the same alleged misconduct.  The cases raises issues as to the applicability of the doctrines of res judicata, autrefois acquit (double jeopardy), and abuse of process in the context of professional disciplinary proceedings.
