Ben Jaffey acted for two Afghan interpreters at risk of reprisals from the Taliban. They were refused the opportunity to resettle in the UK under the Ministry of Defence’s ex gratia redundancy scheme The Divisional Court held that the Ministry of Defence had breached the Public Sector Equality Duty in designing and implementing the scheme but dismissed claims of direct and indirect discrimination. The Court granted permission to appeal to the Court of Appeal.
