In the Matter of an Application by the Family Planning Association of Northern Ireland for Judicial Review

Acting for the fpaNI in ongoing landmark proceedings arising out the NI Department of Health’s continuing failure to produce guidance on abortion services in Northern Ireland.  Following a decision by the Court of Appeal in late 2004 declaring the Department to be in breach of statutory duty for failing to investigate and produce guidance in this difficult and controversial area, the Department has failed, notwithstanding the Court’s order, to finalise draft guidance, and it is anticipated that further application may need to be made to the NI Court of Appeal next year.
