McPhail v Bourne

Ian Mill QC and Tom Weisselberg acted for the Defendants in this high profile case involving two former members of the band Busted.

The Defendants (James Bourne and Matt Willis) were sued by two individuals with whom they had worked before they became famous.  The case involved issues of authorship, copyright ownership, copyright infringement, undue influence, breach of fiduciary duty and partnership. 

After a 19 day trial, Morgan J roundly rejected the evidence of the Claimants, dismissed the claims in their entirety and made an indemnity costs order in the Defendants' favour.
