The High Court has granted an injunction in an abuse of dominance case requiring O2 to continue supply to customers using GSM gateways. The Claimant, Packet Media, operates a service enabling its customers to make use of GSM gateways using O2 SIM cards. In June 2015, O2 indicated that it intended to cease supply to those SIM cards. Packet Media brought proceedings alleging (inter alia) that O2 would be abusing a dominant position if it were to do so, contrary to section 18 of the Competition Act 1998. The High Court found that such claim was seriously arguable, and that the balance of convenience favoured the grant of interim relief so as to preserve the status quo pending trial.
