Robert Howe QC and Shaheed Fatima represented Pink Floyd Music Ltd and another Pink Floyd company in successfully resisting EMI’s appeal to the Court of Appeal. EMI were appealing summary judgment, which had been granted to Pink Floyd by the Chancellor in March 2010 for declarations regarding the proper construction of clauses in their licence agreement with EMI. One of the declarations obtained was that EMI was not entitled, under the licence agreement, to exploit the sale of albums by way of online distribution in any configuration other than the original, album, configuration.
