Sanofi-Aventis

Acting for Sanofi-Aventis in defending all of the damages claims brought against it arising from its role in the EC Vitamins Cartel.  So far there have been three rounds of proceedings in the Commercial Court (the Provimi litigation which has led to the leading English case on jurisdiction and multi-state cartels), the Deans Food litigation in the CAT (under s.47A CA 1998), and the current Faccenda litigation in the High Court.  The Faccenda litigation is currently fixed to determine preliminary issues of wide-ranging importance to competition litigation (e.g. availability of exemplary damages, accounting remedies, restitutionary remedies).
