The CA has handed down judgment in this case concerning the complex statutory provisions on the right of abode for those who are not British citizens. Ivan Hare successfully argued that both the First-tier Tribunal and the Upper Tribunal were wrong to have found that the Respondent had a right of abode in the United Kingdom. The CA restored the Secretary of State’s decision to refuse to grant a certificate of entitlement to the Respondent.
