The Court of Appeal has referred to the European Court of Justice questions relating to the temporal scope of the Citizenship Directive (2004/38/EC) – in particular, the question of whether a period of residence wholly predating the implementation date of the Directive can give rise to the right of permanent residence set out in Article 16 of the Directive (which is acquired after five years’ continuous legal residence by an EU citizen in the host member state).
