The Supreme Court has ruled on the circumstances in which the BBC is covered by the Freedom of Information Act, holding that where it held information for the purposes of journalism, art or literature, such information fell outside the scope of the Act and need not be disclosed, irrespective of whether it was also held for other purposes. The Supreme Court accepted the BBC's submissions that this construction of the Act properly recognised the importance of the BBC being able to exercise its rights of freedom of expression without interference.  The judgment has important implications for all public service broadcasters.
