Darty Holdings SAS v Carton-Kelly

In the £83m preference claim brought by the liquidator of the collapsed Comet Group against Comet’s former owners, Darty Holdings, Miles J. has handed down judgment, dismissing Darty’s appeal from the determination of key preliminary issues against it at trial, last June. The ruling considers (among other things) the IA86 s.435 definition of “association”, and the “look back” period for insolvency clawback claims.
