The Divisional Court (Warby LJ and Holgate J) has upheld a claim brought by organisers of a vigil planned to be held on Clapham Common in memory of Sarah Everard, for breaching their rights to freedom of association and expression.

The Court has held that the police’s decision-making process and interventions that caused the planned vigil to be cancelled by the claimants represented an interference with their rights under Articles 10 and 11 that was not in accordance with the law.
