The High Court on 16 September 2025 handed down its decision in Mazur & Anor v Charles Russell Speechlys LLP [2025] EWHC 2341 (KB). This is a significant case concerning the right to conduct litigation under the Legal Services Act 2007.

The issue which arose was whether a non-authorised person (such as a paralegal) could conduct litigation under the supervision of a qualified solicitor. The issue arose in the context of a debt claim in the County Court, which went on appeal on this issue to the High Court.

The Solicitors Regulation Authority and Law Society were invited by the High Court to make submissions on the appeal.

The High Court held that individuals who are not authorised or exempt under the 2007 Act could not conduct litigation. While such a person may support a qualified solicitor in conducting litigation, only those who are authorised or exempt under the 2007 Act are entitled themselves to conduct litigation.

Tom Lowenthal represented the Solicitors Regulation Authority.
