Municipio de Mariana v BHP Group plc and BHP Group Ltd

The claim was brought in England by more than 200,000 Brazilian claimants in relation to the collapse of the Fundao Dam in Brazil in 2015. Turner J struck out the claim as an abuse of process. He also held that, had he not struck out the claim, he would have stayed the claim on jurisdictional grounds: pursuant to Article 34, Brussels Regulation (recast) in relation to BHP Group plc and pursuant to the doctrine of forum non conveniens in relation to BHP Group Ltd.
