Mrs Justice Lang today handed down judgment in R (Oriaku) v Nursing and Midwifery Council [2017] EWHC 235 (Admin). This involved a judicial review challenge to the Registrar’s decision not to refer to the NMC’s Investigating Committee a complaint that various nurses’ entries onto the NMC register were fraudulent or incorrect.

This judgment provides important guidance on the scope of the NMC Registrar’s triage powers and obligations, which have never previously been judicially considered. The Judge found that the Registrar was entitled to investigate and filter out complaints where there was no proper basis for referral, such as where the individual nurse complained about was not on the register at the time of the complaint, or where there was no basis for the assertion that their registration was fraudulently procured or incorrectly made.
