The FIA International Court of Appeal has allowed appeals by Red Bull Racing and McLaren Racing against a decision of the Stewards of the Formula One Monaco Grand Prix 2026 to rescind two five-second penalties given to Pierre Gasly of Alpine during the race. The ICA’s decision dated 3 September found that the Stewards’ decision fell to be overturned because (i) it was based on the impermissible alteration of a parameter of the competition after the event (paras 71-85), and (ii) there was in any event an insufficient evidential basis for the alteration (paras 86-91). As a result of the decision, which is available here, the two penalties will now be reinstated (para 99).
James Segan KC acted for Red Bull Racing, one of the two Appellants.
Adam Lewis KC acted for the FIA, the Respondent.
