On 23 March 2023, the High Court handed down judgment in an important case about the lawfulness of the Foreign Secretary’s decision-making process when assessing how to assist a British citizen in detention overseas, applying the Court of Appeal’s judgment in R(Abbasi) v SSFCA [2002] EWCA 1598. The case concerns Nnamdi Kanu, the leader of the Indigenous People of Biafra, who has been in detention in Nigeria since 27 June 2021.
