The Court of Appeal has handed down judgment in a jurisdiction challenge relating to the scope of the jurisdictional gateways for claims in tort (§§3.1(9)(a)-(c) of Practice Direction 6B).
The judgment provides useful guidance on the scope of the principle in Dolphin Maritime Services v The Swedish Club [2009] 1 CLC 460, that damage is suffered in the place where, but for the alleged wrongdoing, a benefit would have been received.
