In two judgments dated 15 September 2016 the General Court partially granted the applications brought by Viktor Yanukovych, the former President of Ukraine and his son, the businessman, Oleksandr Yanukovych.

By their applications they sought the annulment of their listing in sanctions measures which were adopted by the EU in view of the situation in Ukraine after February 2014. The General Court annulled the listing of both Viktor and Oleksandr Yanukovych in the 2014 sanctions, concluding that the evidence relied on by the Council – a single letter from the Ukrainian authorities – did not constitute a sufficiently solid factual basis for their inclusion on the sanctions list.

Pushpinder Saini QC and Shaheed Fatima QC acted for Viktor and Oleksandr Yanukovych.
